A separation agreement solves these type problems because it allows you and your spouse to make the decisions for your family not a judge. A divorce separation agreement can be tailored to your individual situation not the “one size fits all” approach that some judges use. The judge will still have to approve the agreement made between you and your spouse but normally they will approve unless it is grossly unfair.
